These Terms are a legal agreement between you and Vibart. Please read them carefully.

1. Acceptance of Terms

By accessing or using Vibart (the “Service”), you agree to be bound by these Terms. If you do not agree, please stop using the Service immediately.

2. Eligibility & Accounts

  • You must provide accurate info. You are solely responsible for all activity under your account and for safeguarding credentials.

3. Acceptable Use & Content Moderation

You agree not to misuse the Service. Specifically, we reserve the right to remove, delete, or disable access to any content (including but not limited to uploaded assets, generated images, canvas projects, and community posts) at any time and without prior notice or consent, if we determine that such content:

  • Contains NSFW, sexually explicit, or suggestive material;
  • Contains politically sensitive information;
  • Infringes upon the intellectual property rights of any third party;
  • Violates the regulations or policies of our third-party partners (e.g., AI model providers, payment gateways, etc.).

4. AI Generated Content & Data Preservation

You understand AI outputs are algorithmically generated and may be inaccurate, incomplete, or similar to others. Vibart makes no warranties regarding accuracy or suitability. Furthermore, Vibart has no obligation to preserve or back up user-generated or uploaded content (including projects, images, conversations, etc.). Vibart shall not be liable for any loss or deletion of such content for any reason, including system failures, account termination, or service adjustments.

5. Fees & Credits Policy

The Service uses a Credits mechanism. You understand and agree: all Credit purchases and top-ups are strictly NON-REFUNDABLE under any circumstances. Credits have no cash value and cannot be redeemed for currency.

6. Disclaimers (Important)

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Vibart expressly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and that the Service will be uninterrupted or error-free. Use of the Service is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Vibart and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, or any claims arising from AI outputs, even if advised of the possibility. In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Vibart. These Terms do not grant you any IP licenses except for personal use of the Service.

9. Amendments & Termination

We reserve the right to modify these Terms. Continued use constitutes acceptance. We may suspend or terminate your account at any time without notice for violations.
